Freedom of Information Act Policy

1. Introduction

Southgate Pharmacy (owned by Kelixio Ltd) is a private company that provides both private and NHS services. While the Freedom of Information Act 2000 (FOIA) does not apply to our private commercial activities, it does apply to the information we hold and manage in connection with our NHS contracts.

This policy outlines our commitment to transparency and our procedure for handling requests for information under the FOIA, specifically for our NHS-related services.

2. Scope of this Policy

This policy applies to information held by Southgate that relates to our NHS-contracted services, including:

  • Our NHS pharmacy contract and service agreements.
  • Data on the performance of our NHS services.
  • Information concerning the provision of NHS services such as prescriptions and clinical services (e.g., NHS blood pressure checks, Pharmacy First).
  • Our NHS-related clinical governance and operational policies.

This policy does not apply to information related to our private, non-NHS business activities, such as our private healthcare services, marketing, or commercial financial data.

3. Making a Request

All requests for information under the Freedom of Information Act must be made in writing and sent to the following email address:

4. Our Procedure for Handling Requests
  • Acknowledgement: We will acknowledge your request in writing.
  • Time Limit: We will respond to your request within 20 working days of receipt. If we require clarification, the time limit will be paused until we receive the necessary information from you.
  • Response: We will either provide the requested information or explain why we are unable to do so, citing the relevant exemptions under the FOIA.
5. Fees and Charges

In most cases, we will provide the information free of charge. However, we reserve the right to charge a fee for large or complex requests where the cost of locating and providing the information exceeds the legal limit defined by the FOIA. We will inform you of any potential charges before proceeding with the request.

6. Exemptions

The Freedom of Information Act contains a number of exemptions that allow us to withhold information. These include, but are not limited to, information that:

  • Relates to personal data (which is handled under the GDPR and our Privacy Policy).
  • Is commercially sensitive.
  • Is protected by legal privilege.
  • Would prejudice the effective conduct of public affairs.
7. Publication Scheme

In line with our obligations as an NHS-contracted service provider, we have a Publication Scheme. This scheme outlines the types of information we proactively make available to the public. This includes key details about our services and policies.

8. Right to Appeal

If you are not satisfied with our response to your FOIA request, you have the right to request an internal review. If you remain dissatisfied after the internal review, you may then contact the Information Commissioner’s Office (ICO) for an independent review.
